DSSMS Bulk SMS Service Terms and Conditions

1. Service Description: a. DSSMS offers bulk SMS services enabling Customers to send messages to multiple recipients simultaneously via SMS. b. The service includes message delivery, reporting, and related features.

2. Customer Responsibilities: a. The Customer is responsible for all content transmitted through the service. b. The Customer must comply with all applicable laws and regulations regarding SMS communications, including but not limited to regulations on spam and unsolicited messages. c. The Customer must maintain accurate contact lists and obtain necessary consents for message recipients.

3. Prohibited Activities: a. Sending unsolicited messages (spam) or messages that violate applicable laws. b. Using the service for illegal purposes or activities. c. Impersonating another person or entity.

4. Message Content: a. Messages must not contain prohibited content including but not limited to hate speech, adult content, or illegal materials. b. DSSMS reserves the right to refuse to transmit any content that violates these Terms.

5. Fees and Payments: a. The Customer agrees to pay all fees associated with the use of the service as per the agreed terms. b. Failure to pay fees may result in suspension or termination of service.

6. Service Availability: a. DSSMS will make reasonable efforts to ensure the availability and reliability of its services. b. Service interruptions may occur due to maintenance or unforeseen circumstances.

7. Privacy and Data Security: a. DSSMS will not disclose or use Customer data for purposes other than providing the service. b. DSSMS will take reasonable measures to secure Customer data.

8. Intellectual Property: a. DSSMS retains all rights to its software, technology, and intellectual property. b. The Customer may not reproduce, modify, or distribute DSSMS's intellectual property without prior consent.

9. Termination: a. Either party may terminate the service at any time with notice. b. DSSMS reserves the right to suspend or terminate service immediately if the Customer breaches these Terms.

10. Limitation of Liability: a. DSSMS is not liable for any indirect, consequential, or incidental damages arising from the use of its services. b. DSSMS's liability is limited to the amount paid by the Customer for the services.

11. Governing Law: a. These Terms are governed by the laws of India. b. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts in India.

12. Amendments: a. DSSMS reserves the right to modify these Terms at any time. b. Continued use of the service after modifications constitutes acceptance of the updated Terms.
